Al-Wisayyah in The Islamic Estate Planning: The Malaysian Perspective

The considerable increase in the amount of unclaimed inheritance or value deceased's frozen assets over time is a contentious topic among Muslim community Malaysia, and it must be emphasised. It likely that impression misunderstanding regarding planning, management, administration property, particularly appointment property administrators through Islamic concept al-wiṣāyah, has contributed to neglect this topic. This study therefore, aimed at analysing practice al-wiṣāyah Malaysia impediments implementing as an alternative estate planning. Adopting qualitative approach document review, systematic collection, documentation, analysis interpretation, organization primary secondary data was conducted. then subjected content organizing eliciting meaning from collected draw realistic conclusions it. hoped able shed light on subsequently providing clear insight extent which its application conforms al-maqāṣid al-syar 'iyyah for good Muslims. also presents recommendations pertaining importance present day, where law beginning experience era codification that, some extent, will cause difficulties management property.
